Why Your AI Is Making Decisions You Can't Explain (And Why That's Illegal)
Traditional software does what you tell it to. AI systems make decisions you didn't explicitly program. That fundamental difference changes everything.
Traditional software is deterministic. Give it the same input, and you get the same output every time. If your accounting software adds 2 + 2, it always returns 4. When it breaks, you can trace the exact line of code that failed. You can fix it, test it, and deploy it with confidence that the bug is resolved.
AI systems are probabilistic. They calculate probabilities and make predictions based on patterns in training data. Give an AI hiring system the same resume twice, and it might score it differently depending on what other resumes it's recently processed, how the model's confidence thresholds are set, or subtle variations in how the text is parsed.
This isn't a bug—it's how AI fundamentally works.
The implications:
You can't guarantee outcomes. You can only influence probabilities. Your loan approval AI might approve 92% of qualified applicants, but you can't specify which 8% it will reject—or guarantee that 8% is distributed fairly across demographics.
You can't fully explain decisions. Even with explainability tools, you often get correlation-based explanations ("the model weighted these features heavily") rather than causal reasoning ("the model rejected this applicant because..."). Many AI systems operate as black boxes where the exact decision path is mathematically intractable.
Errors emerge from probability distributions, not code bugs. When your AI fails, it's often not because something is "broken" in the traditional sense. It's because the probability distribution learned from training data doesn't match the real-world distribution of cases it encounters in production.
This is why you need different testing approaches, different governance frameworks, and different risk management strategies for AI systems. The tools that worked for deterministic software don't translate to probabilistic systems.

Healthcare AI trained on biased data systematically underdiagnoses cardiac conditions in women and skin cancer in people with darker skin tones. Pulse oximeters overestimate blood oxygen in Black patients, leading to delayed treatment and higher mortality rates.
Air Canada's chatbot gave wrong bereavement fare information—they were ordered to pay damages and suffered significant reputational harm. The airline tried to argue that the chatbot was a separate legal entity. The court disagreed.
According to a 2025 study, nearly a third of survey respondents believe they've lost opportunities—jobs, loans, or other benefits—due to biased AI algorithms.
The AI in healthcare market alone is projected to hit $187 billion by 2030. Every healthcare executive must ask: What's our liability exposure when our AI system makes a wrong diagnosis?
You can't iterate your way out of discrimination lawsuits. The "move fast and break things" philosophy doesn't work when the things you break are people's careers, health outcomes, and access to financial services.

The app's "cameo" feature allows users to upload their likeness and create AI-generated videos of themselves—or their friends—saying anything. Within days of launch, the app was flooded with deepfakes, including videos of OpenAI CEO Sam Altman in impossible scenarios and copyrighted characters like Mario and Pikachu.
The concerns are mounting:
Easy deepfake creation. NPR's testing found that Sora 2 could easily generate conspiracy theory videos, including a fake President Nixon admitting the moon landing was faked. The Washington Post's Geoffrey Fowler watched AI-generated videos of himself getting arrested, burning flags, and making disturbing confessions—none of which happened.
Copyright violations. Users quickly discovered they could feature copyrighted characters. The Wall Street Journal reported that copyright holders must submit examples of offending content rather than having blanket opt-outs, placing the burden on rights holders to police AI-generated content.
Mainstreaming deepfakes. Digital safety experts warn that OpenAI has "rebranded deepfakes as a light-hearted plaything" and that recommendation engines are amplifying this content. As one former OpenAI employee told NPR: "We're already at the point where we can't tell what's real and what's not online."
The race to the bottom. Meta responded with "Vibes," its own AI video platform. CNN reports this is becoming "a new form of communication" where users star in AI-created mini-movies—"copyright owners and professional actors be damned."
The challenge isn't preventing AI-generated content—that ship has sailed. The challenge is establishing provenance: knowing where content originated and whether it's been manipulated. Companies must implement content authentication systems that cryptographically verify the source and history of digital media, especially for high-stakes communications.
3. Fact-Checking and Verification
Traditional verification methods are breaking down. By the time fact-checkers debunk a deepfake, it's been viewed millions of times. Companies need verification workflows integrated into their content pipelines, not bolt-on solutions applied after publication.

Pfizer's AI Governance
Pfizer implements comprehensive AI governance through its AI Center of Excellence, which includes bias-detection systems that help data scientists identify and assess biases in AI algorithms used for drug discovery and clinical trials. The system automatically reviews algorithms and flags potential biases that could affect patient outcomes—ensuring their AI works fairly across diverse patient populations.
Key lesson: Build bias detection into your development workflow, not as a separate audit step. Focus on outcome equity across patient populations, not just input fairness. Embed AI ethics into existing centers of excellence rather than creating siloed ethics teams.
Barclays' Comprehensive AI Strategy
Barclays has established a GenAI Centre of Excellence that serves as a hub for sharing ideas, successes, and lessons learned across the organization. The bank uses AI for real-time fraud detection while continuously monitoring for bias through partnerships with third-party auditors, such as Holistic AI.
Barclays' VP of Quantitative Analytics, Akhil Khunger, explains that generative models bring unique risks to banking environments where explainability, reliability, and compliance are paramount. The bank has implemented real-time monitoring systems, continuous red teaming, and clear accountability structures with regular audits.
The bank partners with the Open Data Institute and has adopted the Data Ethics Canvas to ensure transparency and fairness in AI projects. This structured approach lays the foundation for responsible innovation while efficiently detecting fraud.
Key lesson: Third-party audits build credibility with regulators and customers. Continuous monitoring beats one-time testing. Performance and fairness aren't mutually exclusive—well-designed systems achieve both. Create cross-functional collaboration rather than isolated AI teams.
Financial Services Industry Standards
Financial services firms across the US are implementing bias monitoring under pressure from the Consumer Financial Protection Bureau. UK banks like Barclays have implemented AI systems to prevent discrimination in lending, while regulators require explanations for automated decisions.
Key lesson: Don't wait for enforcement. Documentation protects you in audits. Proactive compliance is cheaper than reactive litigation. The first movers are setting industry standards that will become competitive requirements.
The pattern? These companies treat AI fairness like they treat security testing—as a mandatory step, not an optional add-on.
